Abstract

Arti cle 7(3) of the Act of 21 August 1997 on Animal Protecti on regulates the socalled interventi ons to remove an animal from [the owner’s] custody. Pursuant to this provision, an animal may be removed by a policeman, municipal guard or an authorized representati ve of a public organizati on. The main issue considered by the Supreme Administrati ve Court in the adopted resoluti on was determining the status of a public organizati on in proceedings aimed at removing the animal from the owner. In the authors` opinion, the key is to determine the legal nature of the act of ‘removing an animal from custody’ and its consequences. The conclusion of the commentary boils down to the statement that a representati ve of a public organizati on is an administrati ng enti ty, whose operati on is based on a norm defi ning a task, while the acti viti es of removing an animal from custody which the representative
