Podstawa odpowiedzialności za usterki zamówionego programu komputerowego

Abstract
This paper concerns the grounds for liability for defects in ordered software. For this purpose, the writer presents in brief the historical perspective on the formation of views about applying the warranty regime and the contractual liability regime to software. The paper focuses then on the issue of recognition of Art. 55.1 of Copyright and Neighbouring Rights Law Act as a grounds for the liability in question. Therefore, it was necessary to determine the exact scope of application of the aforementioned provision, which meant in turn finding a proper interpretation of terms 'ordered work' and 'author'. Moreover, the paper answers the question whether the computer program defect can be removed by a person other than the author himself and whether it is appropriate to apply in this scope the rules of Art. 55.1 CNRLA.

- Niniejszy artykuł dotyczy podstaw odpowiedzialności za wady w zamówionym oprogramowaniu. W tym celu pisarz przedstawia w skrócie historyczną perspektywę kształtowania poglądów na temat stosowania systemu gwarancji i systemu odpowiedzialności umownej wobec oprogramowania. Artykuł koncentruje się wówczas na kwestii uznania art. 55.1 Ustawy o prawie autorskim i prawach pokrewnych jako podstawa przedmiotowej odpowiedzialności. Konieczne było zatem ustalenie dokładnego zakresu zastosowania powyższego przepisu, co oznaczało z kolei znalezienie właściwej interpretacji terminów „zamówiona praca” i „autor”. Ponadto artykuł odpowiada na pytanie, czy wadę programu komputerowego może usunąć osoba inna niż sam autor i czy właściwe jest zastosowanie w tym zakresie przepisów
