Abstract

The theme of this article is the legal dimension of the organization and functioning of the National Organization in January Uprising of 1863. By analyzing the ideological and legal basis of insurgent authorities activity led by the National Government, has shown how the phenomenon was „the Polish Secret State” in the years 1862 to 1864. His performance included not only all three partitions but also resulted in intense diplomatic activity. Internally, the central and local authorities of the „state” seemed different types acts, organized courts and other law enforcement authorities and to issue judgments on behalf of the National Government, which was considered by most Poles as the only legitimate authority.
