O kryminalizacji tzw. alienacji rodzicielskiej

Abstract
This paper discusses some fundamental aspects of a new offence of parental alienation, which is intended and demanded to be introduced into the Act of 6 June 1997 – Penal Code. The aspects are analysed based on two recently published draft amendments to the Penal Code: draft amendment initiated by the government in 2019 and subsequently dropped with the end of the 8th term of the Sejm (Sejm paper no. 3254) , and draft amendment submitted to the Senate of the 10th term by citizens on 4 February 2020 (paper no. 63).

- W artykule rozważane są wybrane, elementarne aspekty planowanego i postulowanego wprowadzenia do ustawy z dnia 6 czerwca 1997 r. Kodeks karny nowego typu przestępstwa, polegającego na stosowaniu tzw. alienacji rodzicielskiej. Analiza przeprowadzona jest w oparciu o dwa opublikowane w ostatnim czasie projekty zmian k.k.: projekt rządowy z 2019 r., który uległ dyskontynuacji w związku z końcem VIII kadencji Sejmu (druk sejmowy nr 3254) oraz projekt obywatelski wniesiony do Senatu X kadencji w dniu 4 lutego 2020 r. (druk nr 63).
