Abstract
Relations between the constitutional court and the legislature as an element of the legitimization of the Polish legal system during the transformation period. Legal theory issues This article concerns the issue of the relations between the constitutional court and the legislature in the process of legitimization of the Polish legal system during the transformation period. Legitimization of the legal system is a deliberate argumentative process, which consists of proving legitimacy (rightness) of the binding legal system. The relations between the legislature and the constitutional court enable to demonstrate that the new legal system is legitimate, i.e. that it has a particular justification

- W świetle ustaleń zawartych w niniejszym opracowaniu należy przede wszystkim stwierdzić, że relacje pomiędzy Trybunałem Konstytucyjnym a władzą ustawodawczą stanowią jeden z ważniejszych elementów legitymizacji systemu prawa w okresie transformacji ustrojowej. Pozwalają bowiem wykazywać, iż tworzony system prawa jest prawowity, a zatem posiada uzasadnienie tetyczne i aksjologiczne. Relacje te spełniają ponadto istotne funkcje, w szczególności funkcje społeczne, co sprawia, że wytwory działalności prawotwórczej legislatywy, składające się na system prawa, legitymizowane przez sąd konstytucyjny, mogą liczyć na społeczną aprobatę dla swojego istnienia
