Abstract
The article is a voice in the discussion on the legal status of animals which are victims of crimes defined in the provisions of the Act of 21 August 1997. It presents argumentation to support departure from the result of linguistic interpretation of the legal definition of the victim, contained in the provisions of the Code of Criminal Procedure, which definition is based, inter alia, on functional considerations. The article criticizes the fact that only organizations whose statutory purpose is the protection of animals were granted exclusive authorization to exercise the rights of animals as victims.

- Artykuł jest głosem zabranym w sprawie statusu prawnego zwierząt pokrzywdzonych wskutek popełnienia przestępstw stypizowanych w przepisach ustawy z 21.08.1997 r. W artykule przedstawiono argumentację, która przemawia za przełamaniem rezultatu wykładni językowej definicji legalnej pokrzywdzonego zawartej w przepisie Kodeksu postępowania karnego, opartej m.in. na racjach funkcjonalnych. Krytycznie oceniono przyznanie wyłącznie organizacjom statutowym, których celem jest ochrona zwierząt, wyłączności na wykonywanie praw pokrzywdzonych zwierząt.
