The evolution of legal instruments for the protection of movable cultural property
Alicja Jagielska-Burduk
Abstract
The subject of this thesis is the evolution of legal instruments for the protection of movable cultural property. The project deals not only with the legal status of movable cultural property in three legal acts from 1928 , 1962 and 2003 , but also presents different views in the ongoing international debate on its legal protection. Some claim that the protection should be based on the ownership limitations, as it presently is. Others believe that more radical measures and solutions, i.e. introducing a new legal institution instead of the ownership right, should be sought after. The inspiration for this thesis was the statement made by Jan Piotr Pruszyński. He claimed that the question of cultural heritage should be the subject of constant discussion . The goal of this thesis is not only to be one of many Polish voices in this debate but also to present the evolution of movable cultural property so far.- Record ID
